The Supreme Court on Tuesday adjourned the hearing in a plea filed by Advocate Shashank Shekhar Jha seeking a CBI/NIA probe into the mysterious death of West Bengal BJP MLA Debendra Nath Ray, who was found hanging from a tree on July 13, 2020. He had termed it a political murder.
A three-judge bench headed by Justices Ashok Bhushan, R. Subhash Reddy and M.R. Shah has directed petitioner to file rejoinder within two weeks.
The West Bengal government has filed an affidavit in the matter stating there was no involvement of any government official in the death of BJP MLA Debendra Nath Ray.
“It is denied that the death of Debendra Nath Roy was a political murder or that the state machinery was used or was an accomplice or involved in any manner in causing such death,”
said the affidavit filed by Atreyi Sen, Deputy SP, CID, Malda Zone, West Bengal.
The affidavit said a suicide note was found on BJP MLA Debendra Nath Ray, who was found hanging outside a tea shop in the North Bengal District. The post-mortem revealed it was a case of Suicide.
The West Bengal Government, in its affidavit, has also denied involvement of any state machinery against the people having different ideology.
“It is further denied that there is involvement of any state machinery against people having different political ideology or that is has made impossible to trust the investigation carried out by the police officials of the same administration as falsely alleged,” it said.
Further, the State Government has also denied the allegations that the incident has put fear in millions who had joined the particular political party, to contest election or contest the election independently, terming it as falsely alleged in the petition.

The State Government has also denied that the true spirit of liberty equality or fraternity in a democratic system could be achieved only if the case is investigated by CBI/NIA under the supervision of this honourable court.
