Tripura HC orders Rs 10 lakh compensation to mother of deceased lawyer who died due to medical negligence

The Tripura High Court on Monday ordered a compensation of Rs 10 lakh to the mother of advocate Bhaskar Debroy, who died due to medical negligence at the Gobind Ballabh Pant (GBP) hospital on March 07 , last year.

The division bench of the High Court comprising Chief Justice AK Kureshi and Justice SG Chattopadhyay was hearing a petition filed by advocate Pulak Saha, who has alleged ‘system failure’ by the police and hospital staff.

Bhaskar Debroy, the only child of his widowed mother, had met with an accident on 6th March 2020. He was then taken to GBP Hospital in a conscious state, however, he died on 7th March 2020 after his condition worsened while undergoing medical treatment. The petition claimed that doctors present at the time of admission of Bhaskar Debroy did not care to attend to the patient and revive him.

However, the family members and a few other lawyers came to know about his death in the morning, and when they tried to file an FIR, the police denied.

The enquiry team comprising four senior physicians that the State government had constituted after the death of Bhaskar Debroy also pointed to medical negligence. After getting the report, the state government took action against the two accused doctors. The state health department also terminated the service of Ronit Das, one of the doctors.Das had been appointed on a contractual basis in the AGMC.

A medical audit team looked into all clinical aspects leading to an untimely death. The medical audit team found that Debroy had 17 serious and critical injuries, and he died due to not getting proper treatment.

The bench while taking into account the Magisterial report and Audit Team report came to the conclusion that both the inquiries suggested gross negligence on the part of the doctor and hospital.

The High Court, therefore, ordered the government to pay Rs. 10 lakh compensation immediately to the mother of the deceased. The Court has also granted liberty to the mother of the deceased who could move the civil court demanding further compensation and in such case, the amount would be adjusted to the compensation fixed by the High Court.
