Supreme Court adjourns UP govt challenge to bail granted to Azam Khan wife

The Supreme Court on Monday adjourned the petition of the Uttar Pradesh government against the grant of bail of Tanzin Fatima, the wife of Samajwadi Party leader Azam Khan, and son Mohammad Abdullah, for next week.

The Uttar Pradesh government has challenged the Allahabad High Court’s decision to grant bail. In fact, in October 2020, the Allahabad High Court approved the bail application of Tanzin Fatima and her son Abdullah Azam on the charge of fake birth certificates. She was ordered to be released immediately.

The release of Mohammad Azam Khan was to be made after the recording of statement of complainant Akash Saxena. The Court expected the complainant to record the statement within three months of the opening of the Aligarh court.

This order was delivered by Justice Siddharth while dismissing the bail applications of Dr. Tanzin Fatima, Mohammad Azam Khan and Mohammad Abdullah Azam Khan.

Against the petitioners, BJP leader Akash Saxena has lodged an FIR in the Ganj Police Station of Rampur on charges of cheating, in which police has filed a chargesheet. It is alleged that Azam Khan and Tanzin Fatima have made two birth certificates of their son. One from Nagar Palika Parishad , Rampur and the other one is from Municipal Corporation, Lucknow. There is said to be a great difference between the two dates of birth. 

Abdullah Azam Khan said that he had no role in making the birth certificates. Therefore, he sought his release on bail. Tanzin Fatima said that bail should be granted for being a woman. Therefore, both were ordered to be released immediately. But Azam Khan was ordered to be released after recording the statement of the complainant.

Abdullah Azam Khan is accused of contesting UP Assembly elections by taking advantage of a fake birth certificate. The High Court has cancelled its election.
