ST certificate cancellation: Amit Jogi withdraws plea from Supreme Court

New Delhi (ILNS): Janata Congress’ Chhattisgarh state president Amit Jogi, whose Scheduled Tribe certificate was cancelled by the state level caste screening committee, today withdrew his petition from the Supreme Court. As soon as the matter came up for hearing, Jogi, through his lawyer, made an application to withdraw the petition. The application was accepted by the court.

Senior Advocate Rajiv Dhavan, who pleaded on behalf of the state government, said that a petition has been filed in the Chhattisgarh High Court on behalf of the petitioner’s wife Richa Jogi. Richa has challenged the decision of the state government to cancel the certificate. Apart from Richa’s application, Amit had also filed a petition.

The investigation committee has cancelled the caste certificate of the Petitioner on the basis of the caste certificate of Petitioner’s father, Late Ajit Jogi. The caste of the son is determined by the caste of the father. Therefore, the Kanwar tribal caste certificate of Late Ajit Jogi has already been cancelled by the High Level Caste Investigation Committee.

It is to be noted that Amit Jogi in the petition filed in the Supreme Court had sought revocation of the amendment in the Chhattisgarh State Scheduled Castes, Scheduled Tribes and Other Backward Classes Rules 2013 in September-October 2020, against the law.

Amit Jogi said that on October 27, 2013, on his application, the Tehsildar gave the certificate of Scheduled Tribe. On the basis of this certificate, he won the election by contesting from Marwahi region. Stating that it was fake, Sameera Packra and Sant Kumar Netam had requested caste committee Udha Adhikar Samiti to investigate.

The district certificate committee issued a show cause notice to Amit Jogi on July 4, 2020. After this, the matter was referred to the High Certification Committee of the state based in Raipur.  Meanwhile, Amit Jogi filed a petition in the Supreme Court in October. He has sought to repeal the amendment of the rules on 24 September 2020, saying it is illegal and a violation of Article 14 of the Indian Constitution.
