The Karkarduma Court has granted bail to three North East Delhi Riots accused Osama, Gulfam and Aatir, in the FIR filed by a fruit seller for allegedly looting fruits worth Rs. 2 lac and burning two reharis in his godown during the riots in Feburary last year.
Additional Session Judge 03, Amitabh Rawat while hearing the bail application noted “I cannot help but notice the carelessness with which the charge-sheet has been prepared and filed. The investigation carried out, is perfunctory.”
The bail applications have been filed by accused Osama, Gulfam @ Sonu Chikna and Aatir through their Advocate Abdul Gaffar.
The bench noted “The list of witnesses filed, mentions some witnesses. However, no statement u/s. 161 Cr.P.C of any of the witnesses has been filed with the charge-sheet.”
Mr Rawat observed “Considering the period of custody of the accused persons that they have gone through and the nature of investigation and the chargesheet as stated above, all three bail applications under section 439 Cr.P.C of all the three applicants are allowed.”
The bail has allowed on the condition of furnishing a bail bond of Rs. 10,000 each.
