The Delhi High Court on Tuesday directed all the Municipal Corporations to clear all the arrears of pension and salaries of all the ex and serving employees on or before April 5.
A divisional bench of Justice Vipin Sanghi and Justice Rekha Palli noted, “The Commissioners of each Municipal Corporations shall be personally responsible to ensure compliance of this direction.”
The matters were initially taken up when the COVID-19 pandemic was raging and keeping in view the then-prevailing circumstances since it was well known that the coffers of the government and its instrumentalities, including the Municipal Corporations, were virtually empty.
The situation has since returned to near normalcy and there can be no justification now for non- payment of salary and pension, including arrears thereof, the bench noted.
Senior Advocate Maninder Singh appearing for the India Medical Association submitted that the right to receive salary and pension is a fundamental right and non-payment thereof infringes the very right to live and livelihood of the person entitled to receive the same.
The bench while disposing of the petitions directed, “all the Municipal Corporations to positively clear all the arrears of pension and salaries of all the ex-employees and the serving employees of all categories, on or before 05.04.2021.”
